RETURNS POLICY

The provisions of this returns policy, including the terms and conditions for exercising statutory warranties and the right of withdrawal, form an integral part of the General Terms and Conditions of Sale applicable to purchases made on the www.balmain.com website (hereinafter the ‘Website’) and are governed by the law applicable in accordance with said General Terms and Conditions of Sale, in particular the mandatory provisions of the French Consumer Code (Code de la consommation), where applicable.

The Buyer may need to return the products ordered when they wish to:

• Exercise their right of withdrawal;
• Carry out an exchange, if this option is proposed;
• Return one or more damaged, defective or incorrect items.

The procedures for arranging such returns are set out below.

In any case, we would like to remind you that all products sold on the Website have an identification label with a disposable seal, which forms an integral part of the product. Please try the products before removing either the label or the seal. Products returned without the label and seal will not be accepted.

 

1. Right of Withdrawal

If you are a consumer residing in the European Economic Area, you have a period of fourteen (14) days from the day after receipt of your order to exercise your right of withdrawal, without giving any reason or having to pay any penalties. 

If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

Conditions for exercising the right of withdrawal 

The right of withdrawal from the contract of sale will be deemed duly exercised if all the following conditions are met:

a.    The right of withdrawal has been duly exercised within fourteen (14) days from receipt of the products, following the aforementioned procedures.

b.    The products must not have been used, worn or washed and, in any case, must comply with the conditions set out in the section on Compliance Checks below; 

c.    The identification label and disposable seal remain attached to the products, of which they form an integral part.

d.    The products are returned in their original packaging.

e.    The products are entrusted to the carrier within fourteen (14) days after confirmation by email that your request for withdrawal has been taken into account.

f.    The products are not damaged.

The right of withdrawal is excluded where permitted by law and in particular if you have purchased customised products or in the case of sealed items that have been opened after delivery and that cannot be returned for health or hygiene reasons.

To exercise this right, you must, within the aforementioned period of fourteen (14) days, notify your decision to withdraw by means of an unambiguous declaration:

# either by using the withdrawal form template available [here] or generally available via the links provided on the online store or in the transactional emails received (such as your order confirmation), without the use of this form being mandatory; 

# or via the PIERRE BALMAIN returns portal or, where this is unavailable, by contacting the PIERRE BALMAIN Customer Care department.

To exercise your right of withdrawal, you must provide the necessary information to identify your order, in particular your order number and the email address used to place the order, as requested in this page.

No product should be returned without first applying the relevant return procedure and following the instructions provided.

Your request will be reviewed upon receipt. 

If your request is accepted, you will receive the necessary instructions for the return of the products, including, where applicable, a Return Authorisation Number (RMA), a return label and the address to which the products must be returned.

You must return the products in question, in perfect condition and with all associated accessories, where applicable, in a timely manner and, in any case, no later than fourteen (14) working days after confirmation by email that your request for withdrawal has been taken into account. This time limit is deemed to be met if you return the goods before the expiry of the fourteen (14) day period, at your own expense and via an appropriate delivery method, to the following address:

In the event of confirmation of the conformity of your withdrawal, you will be refunded for the amount corresponding to the product subject to the withdrawal, including delivery costs (except in the case of a partial return of the order, in which case the delivery costs will be borne by the Buyer), without excessive delay and, in any case, no later than 14 (fourteen) days following receipt of the returned goods by the Seller.

 

2. Items returned because damaged, defective or incorrect 

Without prejudice to the application of mandatory consumer protection provisions, if you wish to return a product due to an error on our part or on the grounds that it is damaged or defective, please submit your request via the returns portal or contact the PIERRE BALMAIN Customer Care department.

If a product becomes defective after receipt, please contact Customer Care for further information. 

To return the products, please refer to section 4 ‘Terms and Conditions for Returns’ below.

After an examination of the returned products, they may be replaced, repaired, refunded, reduced in price or any other solution provided for by the applicable regulations, depending on the circumstances and in accordance with the applicable General Terms and Conditions of Sale.

Where a return is accepted for a defective or non-compliant product, the return costs will be covered in accordance with the applicable General Terms and Conditions of Sale and applicable legal provisions.

After an examination of the returned products, they may be replaced, repaired, refunded or reduced in price, depending on the circumstances and in accordance with the applicable General Terms and Conditions of Sale, within a reasonable amount of time. 

Where a return is accepted for a defective or non-compliant product, the return costs will be covered in accordance with the applicable General Terms and Conditions of Sale and applicable legal provisions.

If no defects in the returned products are found, you will be notified that the returned products cannot be accepted and you may choose to have the products redelivered to you at your own expense. If you do not agree to redelivery, the products and their purchase price will be retained and you will be billed for the corresponding fees and charges. 

 

 3. The Returns Process

3-1. Procedure and costs for returning products

You have fourteen (14) days from receipt of your order to exercise your right of withdrawal and return the items ordered on www.balmain.com.

To make a return:

• Please complete the online return form on our website to register your return and generate your return label.

• Carefully pack the item(s) you wish to return to avoid damage during transport, and be sure to include the original delivery note in the package.

• Stick the label over the previous label, so that it is clearly visible.

• Contact DHL via mydhl.express.dhl to schedule a pickup (in the section ‘Ship’ > ‘Schedule a pickup’).

The Waybill Number is shown on the prepaid DHL label (the number under the first barcode on your label); this number also allows you to track your shipment. You can also drop off your package at the DHL point of service of your choice: https://locator.dhl.com/. You can track your package at any time on the ‘Track your return’ page.

We process returns within seven (7) working days of receipt in our warehouse. We will send you email confirmation once your refund has been approved.

You will be refunded for items returned in accordance with the above conditions. If the return does not meet these conditions, the package will be returned to you.

For reasons related to marketing rules, any return must be made from the country in which the order was placed.

3-2. Compliance checks

The products must be returned in their original condition and unused, in perfect condition, intact, complete (original packaging, instructions, warranty certificate, accessories, etc.), clean and in a condition allowing them to be sold. 

In the event of damage to the product resulting from improper handling on your part, you may be held liable. 

We reserve the right not to accept any returned product showing signs of wear or of having been used or modified from its original condition, in any way whatsoever, or, as an alternative, to reduce the amount to be refunded or the value of the exchange, where applicable. 

You will receive a notification in the event that the returned product(s) are not accepted because they do not comply with the conditions indicated above or if we decide to reduce the amount of the refund for the reasons set out above. 

In this case, you may choose to have the product(s) reshipped to you at your own expense. If you do not wish the product(s) to be returned to you, they will be retained, together with the amount paid for their purchase.

 

4. Refund processing times and procedure

Once the returned products have been received and the return conditions verified, you will receive confirmation of the acceptance of your return.

Depending on the applicable case, the refund may cover:

• The full price of the product (s) concerned;
• A portion of the price, if the products have lost value, in which case you will be informed of the amount deducted from the refund
• Or, if proposed/requested, an exchange.

Regardless of the method of payment used, the refund will be processed as soon as possible and, in any case, within fourteen (14) days from the date on which we became aware of your decision to exercise your right of withdrawal or your request for a return or an exchange, and once we have ensured that the return has been carried out in accordance with the aforementioned conditions.

You will be refunded using the same payment method used for the initial transaction, unless expressly agreed otherwise. In any case, you will not incur any costs for the refund.

The time taken to refund the amount paid for the purchase of the returned products depends on the method of payment used. For example:

•    Purchase by credit card: the refund processing time will depend on the company that issued the card, but will normally take place within two billing cycles. The value date of the credit will be the same as the original debit. You will therefore not suffer any loss in terms of bank interest.

• Payment via PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual refund to the credit card associated with your PayPal account will depend on the company that issued the card.

•    Payment on delivery (where applicable): we will refund the bank account you have indicated, so the refund processing time will depend on the accuracy of the information you have provided, but will generally take fourteen (14) days.
